To enter the “Win 1 of 10 Vancouver 2010 Gold Collector Coin Sets” contest (the “Contest”) simply visit www.celebratecheese.ca, click on the Contest icon. The participant (the “Participant”) enters by filling out the online entry form (the “Entry Form”) clearly stating the following information: full name, complete mailing address, daytime telephone number, age range, email address, acceptance of the Contest Rules and Regulations and include one (1) listing of a twelve (12) digit UPC number from any Saputo, Armstrong, Bari product (the “Participating Products”). Limit of one (1) Entry Form per person per day. Only one email address may be used by a Participant to participate in the contest.
In the event of a dispute regarding any Entry Form, the Entry Form will be declared made by the authorized account holder of the email address submitted at the time of the entry (i.e. the person who is assigned to an email address by an Internet access provider, on-line service provider or other organization that is responsible for assigning e-mail address for the domains associated with the submitted e-mail address)
There is no purchase necessary to enter the Contest. Participants may obtain a UPC code by writing down the UPC code from a Participating Product on a piece of paper while in a store.
Only one (1) Entry Form, per Participant, per email address, per day will considered for the purpose of this Contest. The Contest is organized by Saputo Foods Limited. (the “Sponsor”).
The Contest is only open to legal residents of Canada who are of the age of majority in the province in which they are resident at the time of entry. Employees of the Sponsor, its advertising agencies, the Contest Judging Organization (hereinafter defined), promotion and service agencies, VANOC, and members of their immediate families (spouses, parents, siblings and children and each of their spouses) and persons living in the households of each of these individuals, whether related or not, are not eligible to participate in the Contest.
The Sponsor may require at any time proof of the identity and/or eligibility from the Participant to allow him/her to participate in the Contest. Failure to provide such proof within a reasonable period of time could result in disqualification.
All information supplied to the Sponsor for the purpose of this Contest must be truthful, accurate and complete. The Sponsor reserves the right to disqualify any Participant should his/her Entry Form include untruthful, inaccurate or incomplete information.
The Contest starts September 28, 2009 at 12:01am (Eastern Time) and closes at 11:59pm (Eastern Time) on November 9, 2009 (the “Contest Period”). All Entry Forms must be received no later than the close of the Contest Period. Any Entry Form received after the Contest Period will be declared invalid and will not be eligible for the Prize Draw (hereinafter defined).
On November 23, 2009 at 10:00am (Pacific Time), a random draw (the “Prize Draw”) from all Entry Forms received within the Contest Period will be conducted by Consumer-Response Marketing (the “Contest Judging Organization”) in Surrey, British Columbia. The Contest Judging Organization’s computer system will be used to make random draws. The odds of being selected in this Contest are dependent upon the total number of eligible Entry Forms received.
There are ten (10) prizes available to be won each consisting of a Vancouver 2010 14-Karat Gold Coloured Three-Coin Set with an approximate retail value of one thousand five hundred dollars in Canadian currency ($1500.00 CDN). Each coin set (#1059256-23932-01920-1) features three (3) select 14 karat gold colour coins arranged in a dramatic showcase. (the “Prize”).
The Prize must be accepted as awarded. No cash equivalent or exchange of Prize is permitted. All aspects of the Prizes are non-transferable. The Sponsor reserves the right to make substitutions for the Prizes, which in the opinion of the Sponsor, are of similar kind or value, without prior notice.
The Participants whose names are drawn will be contacted by telephone. The Contest Judging Organization will only contact selected Participants. Attempts will be made to contact the selected Participants during regular business hours for a period of five (5) business days after the date of the Prize Draw. If a selected Participant cannot be contacted or fails to respond to any telephone message left by the Contest Judging Organization’s representative within this period, then he or she will forfeit any right to the Prize and the Sponsor, in its sole discretion, may ask the Contest Judging Organization to select an alternate Participant or withdraw the Prize.
Selected Participants must claim their Prizes as directed by the Sponsor by no later than ten (10) business days after the date of the Prize Draw. If a selected Participant has not claimed his or her Prize within this period, then he or she will forfeit any right to his or her Prize and the Sponsor may, in its sole discretion, ask the Contest Judging Organization to select an alternate Participant or withdraw the Prize.
The Prizes will be delivered to the Winners (hereinafter defined) by courier service.
All Entry Forms are the property of the Sponsor and will not be returned for any reason whatsoever.
By participating in the Contest, the Participants unconditionally agree to be bound by the Contest rules & regulations (the “Contest Rules & Regulations”). The Participants further agree to be bound by the decisions of the Sponsors regarding the Contest Rules & Regulations or in any way relating to this Contest, as may be determined by the Sponsor in its sole discretion, which will be final and binding in all respects.
All personal information of the Participants gathered through the Contest (the “Personal Information”), such as their name, address, telephone number, e-mail address and age is collected solely for the purposes of administering this Contest. Each Participant, by entering the Contest, consents to and grants the Sponsor the right to use their Personal Information for the purpose of administering the Contest. Personal information will not be provided to any third party, other than as provided for in these Contest Rules & Regulations.
Before being declared a Winner (the “Winner”), collectively the winners (each a “Winner”), the selected Participant must successfully answer without assistance or mechanical aid, a time-limited mathematical skill-testing question as a condition to receiving a Prize.
The Sponsor reserves the right, in its sole discretion, to disqualify any selected Participant who: (a) cannot be reached by the Contest Judging Organization by telephone or has not responded to telephone messages left within five (5) business days of the Prize Draw; (b) is unwilling or unable to comply with the Contest Rules & Regulations; (c) has not correctly answered the skill-testing questions within the allotted time; (d) has not claimed the Prize as directed by the Sponsor within ten (10) business days of the Prize Draw; (e) has tampered or attempted to tamper with the entry process or the operation of the Contest; (f) has not signed the Declaration, Release and Waiver Form (hereinafter defined) in the form required by the Sponsor within ten (10) business days of the Prize Draw; or (g) for any reason whatsoever is unable to accept the Prize as awarded. In all such cases, the selected Participant will forfeit his or her right to the Prize without compensation and the Sponsor may, in its sole discretion, ask the Contest Judging Organization to select an alternate Participant or withdraw the Prize.
Neither the Sponsor nor its affiliates, subsidiaries, sponsors, suppliers, the Contest Judging Organization or otherwise make any warranty, representation or guarantee, express or implied, in relation to a Prize, including without limitation quality, merchantability or fitness for a particular purpose.
By entering into this Contest, all Participants (including the Winners) hereby agree to release, discharge and hold harmless the Sponsor, its affiliates, subsidiaries, sponsors, suppliers and advertising, promotion and service agencies involved in this Contest, including all of their respective directors, officers, employees or agents, and VANOC from any and all loss, harm, liability, claims, damages, causes of action, costs or expense of any kind whatsoever with respect to or arising out of: (a) the Participant’s participation in the Contest; (b) the Participant’s participation in any Contest-related activity; (c) the Participant’s acceptance, use, misuse or any other matter in relation to a Prize; (d) the distribution of the Prizes; or (e) the administration of the Contest.
The Sponsor and its parents, affiliates, subsidiaries, suppliers and advertising promotion and service agencies involved in this Contest, including all of their directors, officers, employees or agents are not responsible for and will assume no liability for any condition caused by events beyond the Sponsor’s control which affects the Contest including: (a) Entry Forms which are lost, late, delayed, incomplete, illegible, damaged, destroyed, irregular, mutilated, forged, garbled, incorrectly addressed, misdirected, mechanically reproduced or are otherwise in any way not entered or eligible for the Contest; (b) incorrect or inaccurate information in the Entry Forms or in relation to the administration of the Contest whether caused by any of the equipment or programming associated with or utilized in the Contest or by any technical or human error which may occur, including without limitation typographical errors; (c) telephone, technical, network, online, electronic or computer failures of any kind regardless of the cause in relation to the administration of the Contest; (d) the failure of the Sponsor to notify any selected Participant that his/her name has been drawn for any reason whatsoever; (e) the failure of the Sponsor to receive a selected Participant’s response for any reason whatsoever; (f) theft or destruction or unauthorized access to, or alteration of, Entry Forms; (g) any error in compiling Entry Forms; (h) any error in awarding Prizes.
Prior to being awarded the Prize, the selected Participant must sign and return a declaration, release and waiver form (the “Declaration, Release and Waiver Form”) in the form required by the Sponsor and any other documentation required by the Sponsor, which will include without limitation: (a) confirmation of eligibility for the Contest; (b) confirmation of compliance with the Contest Rules & Regulations; and (c) a release of the Sponsor and its affiliates and subsidiaries and all of its respective directors, officers, employees and agents, and VANOC from any and all liability for any damage or loss related to, resulting or arising from or in connection with the Prize or the Contest. If the Sponsor does not receive the selected Participant’s Declaration, Release and Waiver Form, within ten (10) business days of the Draw Date, then such selected Participant forfeit his or her right to the Prize and the Sponsor may, in its sole discretion, ask the Contest Judging Organization to select an alternate Participant or withdraw the Prize.
By acceptance of a Prize, Winners consent to the use of their name, city and province of residence, biographical information, likeness, videos, photographs, voice, statements or testimonials in any advertising, promotion and for publicity purposes in connection with this Contest, other promotions and for general news and information purposes, without further compensation or notice.
This Contest is subject to all federal, provincial and municipal laws and regulations. These Contest Rules & Regulations are subject to change without notice in order to comply with any applicable federal, provincial or municipal laws.
The Sponsor reserves the right, with the consent of the Régie des alcools, des courses et des jeux (the “Régie”), to cancel, suspend or modify the Contest, should a virus, bug, computer problem, unauthorized human intervention or other cause beyond the Sponsor’s control, corrupt or affect the administration, security, fairness, integrity or proper conduct of the Contest.
Any litigation respecting the conduct or organization of the Contest may be submitted to the Régie for a ruling. Any litigation respecting the awarding of a prize may be submitted to the Régie only for the purpose of helping the parties reach a settlement.
All intellectual property and all of the promotional materials, web pages and source code are owned by the Sponsor and/or its affiliates. All rights are reserved. Copying or unauthorized use of any copyrighted material or trade-mark without the express written consent of its owner is strictly prohibited. ARMSTRONG, BARI and SAPUTO are registered trade-marks owned by Saputo Dairy Products.
